Suite à la plainte pour diffamation déposée il y a deux ans par Pizza Hut
contre Abdel Mabrouki, délégué syndical Cgt, pour un tract intitulé "Shame on you Pizza Hut", la 17ème Chambre du Tribunal Correctionnel de Paris a
aujourd'hui débouté la société de restauration rapide.

Après deux tentatives de licenciement pour des motifs bidons, nouvel échec dans la stratégie de cette entreprise d'exploitation internationale pour éliminer et faire taire ce syndicaliste actif.

Charges against union activist dropped

Pizza Hut pursued a delegate CGT(FRENCH TRADE UNION) for public defamation. Abdel Mabrouki had drafted a pamphlet criticizing the conditions of safety(security) of the deliverers.

The pursuits for public defamation engaged(opened) by Pizza Hut against a delegate CGT(FRENCH TRADE UNION), Abdel Mabrouki, were considered prescribed on Tuesday by the court dealing with criminal matters of Paris, the complaint having been put down(deposited) more than three months after the blamed facts.

Abdel Mabrouki was pursued as writer of a pamphlet criticizing the conditions of safety(security) of the deliverers, which had been spread(diffused) in 62 establishments during the day of June 14, 2001. The company had made notice by a bailiff that this pamphlet, entitled " Shame one you, Pizza Hut ", had been posted(shown) this day on the shop window of an establishment of the IX-th district of Paris, even distributed to the passers-by.

" Helmets and bécanes are in a mediocre state. Because of that, a deliverer was killed in January. The direction(management) did not even give the punishment(effort) to honour its memory ", said the pamphlet, in reference to the fatal accident a deliverer of pizza Hut of which had been a victim in January, 2001 in Le Mans.

The court, following the arguments of the accused, considered that Abdel Mabrouki had not wished such a public distribution(broadcasting), his(her) editorial staff having originally been intended only for the trade-union panels and for the employees of Pizza Hut, bound(connected) by a community of interest.
" Nothing comes to establish with certainty " that can be attributed(awarded) to Abdel Mabrouki the advertisement which received its comments, " beyond the circle of the employees of companies(societies) exploiting(running) the mark(brand) Pizza Hut ", judged the court.
As a result, according to the magistrates, Abdel Mabrouki, anyway, could be pursued only for the fine of not public defamation.
